Administrative Instruction No. 16/2013 on Substances that Deplete the Ozone Layer and Fluorinated Greenhouse Gases is a sub-legal act approved by the Government of the Republic of Kosovo, which aims to regulate the gradual reduction and elimination of the consumption of substances that deplete the ozone layer, as well as the reduction of emissions of fluorinated greenhouse gases.​

Purpose and Main Objectives:

  • Reduction and Elimination of Ozone Depleting Substances: The Directive sets out measures to gradually reduce and, ultimately, eliminate the use of substances that deplete the ozone layer.​
  • Reduction of Fluorinated Greenhouse Gas Emissions: The aim is to reduce emissions of fluorinated greenhouse gases, which have a high global warming potential.​

Scope:

This Directive applies to:​

  • Controlled and New Substances: Includes ozone depleting substances and fluorinated greenhouse gases, as well as products and equipment containing them.​
  • Related Products and Equipment: Regulates the production, import, export, placing on the market and use of products and equipment containing these substances.​

Basic Principles:

  • Principle of Prevention: Preventing emissions of ozone depleting substances and greenhouse gases fluorinated.​
  • Substitution Principle: Promoting the use of alternative substances that are less harmful to the environment.​
  • Responsibility Principle: Determining the responsibilities of economic operators in the management of these substances.​

Obligations of Economic Operators:

  • Registration and Reporting: Operators must register and report the quantity of substances imported, exported, produced or used.​
  • Labels and Information: Products and equipment containing these substances must be clearly labelled and contain information for users on their content.​
  • Personnel Training: Ensuring that personnel engaged in the management of these substances are trained and certified.​

Corrective Measures and Sanctions:

In case of violations of the provisions of this instruction, corrective measures and administrative sanctions are foreseen against economic operators that do not comply with the legal requirements.​
